Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Trackara Education platform at edu.trackara.app (the "Service") operated by Trackara ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility and Accounts
You must be at least 13 years old to use the Service. By creating an account, you represent that you are eligible and that all information you provide is accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Instructors must be affiliated with a licensed institution to access instructor features. Student accounts are created through enrollment in a course or via a join code provided by an instructor.
2. Description of the Service
Trackara Education is a curriculum management platform for automotive programs. The Service includes tools for course creation, assignment management (repair orders, diagnostic exercises, checkpoints), student progress tracking, grading, and integration with Learning Management Systems (LMS). Features available to a specific user depend on their role (student or instructor) and their institution's license.
3. Institutional Licenses
Institutions (schools, CTE programs, community colleges) access the instructor and course management features through a subscription agreement with Trackara. The terms, pricing, and scope of institutional licenses are set out in a separate agreement with the institution. These Terms govern individual users' access to the Service.
4. Student Subscriptions
Students access course features through the Trackara Pro mobile application, which requires a separate individual subscription. The institution does not purchase student subscriptions on students' behalf. Students subscribe directly through the Trackara Pro app. Trackara Pro subscriptions are governed by the Trackara Pro Terms of Service available at trackara.app.
4b. Student Graduation Benefit
Students who complete a Trackara Education program as determined by their instructor or program administrator (course marked complete within the platform) are eligible for six (6) months of complimentary access to Trackara Pro at the full professional subscription level. This benefit is applied automatically upon program completion — no separate application or code is required.
"Completion" is defined as an instructor or institution administrator marking the student's enrollment in a Trackara Education course as complete within the platform. Partial course completion does not qualify unless explicitly designated as complete by an instructor.
The graduation benefit provides access to the same Trackara Pro plan available to professional subscribers at the time of graduation. If Trackara Pro subscription tiers change after a student's benefit is activated, the student retains the access level that was active at the time of their benefit activation for the full six-month period.
Students who are currently paying a Trackara Pro subscription at the time their graduation benefit is activated will have their subscription paused for the duration of the benefit period and resumed automatically at the end of the six months, unless they cancel.
The graduation benefit is non-transferable and may only be applied once per student per institution enrollment. Trackara reserves the right to modify or discontinue the graduation benefit program with 90 days' notice to partner institutions. Existing activations will be honored.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Submit false, misleading, or fraudulent assignment data or grades.
- Attempt to gain unauthorized access to other users' accounts or data.
- Reverse engineer, copy, or attempt to extract the source code of the Service.
- Use the Service in a way that could damage, disable, or impair the platform or its infrastructure.
- Share your account credentials with others or access the Service using another person's credentials.
6. Content and Intellectual Property
You retain ownership of content you create within the Service (e.g., assignments, repair orders, uploaded documents). By submitting content to the Service, you grant Trackara a limited license to store, display, and process that content as necessary to operate the Service.
Trackara retains all rights to the Service itself, including its design, software, and features. Nothing in these Terms transfers ownership of Trackara's intellectual property to you.
7. Student Records
For institutions subject to FERPA, Trackara acts as a school official and handles student education records in accordance with FERPA requirements and our Privacy Policy. Instructors and institutions are responsible for ensuring their use of student data through the Service complies with applicable privacy laws.
8. Availability and Modifications
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue features of the Service at any time with reasonable notice. We are not liable for any interruption or loss of access.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that any defects will be corrected.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Trackara shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of business opportunity, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Trackara and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Termination
We may suspend or terminate your access to the Service for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections 6, 9, 10, 11, and 13 survive termination.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Texas.
14. Changes to These Terms
We may update these Terms from time to time. We will notify active users of material changes via email or an in-product notice. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.
